Purpose
The purpose of these Terms and Conditions (“Terms and Conditions”) is to define the terms and conditions for the provision of website www.fluo.grandest.fr and the Fluo Grand Est applications, hereinafter referred to as the “Service”, and the conditions of use of the service by the User.
The Service consists of:
- A multimodal information service for the entire Grand Est region and neighbouring areas
- Information on the Fluo Grand Est transport network
It also allows the user to create a personalised profile, in order to save to:
- save certain content as favourites: lines, stops, addresses,
- receive email notifications of disruptions affecting the lines and stops added to their favourites, as well as general disruptions.
Any access and/or use of the Service implies acceptance and compliance with the terms of these Terms and Conditions and their unconditional acceptance. They therefore constitute a contract between the service and the User.
Definitions
- User: the “User” is any person who uses the site or one of the services offered on the site
- Email: the term “Email” means the email address that will be used for all communication between the User and the site.
- Password: the “Password” is confidential information, which the User must keep secret, allowing them, when used in conjunction with their email, to prove their identity.
Terms of Use
The Service is accessible free of charge to any User with Internet access. All costs relating to access to the service, whether hardware, software or Internet access costs, are the sole responsibility of the User. The User is solely responsible for the proper functioning of their computer equipment and their Internet access.
Certain sections of the site are reserved for Users identified using their Email and Password.
The User undertakes not to usurp the identity of a third party.
The User undertakes not to modify the original purpose of the service.
The User undertakes not to use the service to transmit to the Grand Est Region any comments of a racist, denialist, sexist, homophobic, paedophilic or discriminatory nature, or likely to undermine the dignity of others or public order.
The User undertakes not to use the service to transmit data or information to the Grand Est Region without respecting the applicable regulations (copyright, respect for privacy, image rights).
The Grand Est Region reserves the right to refuse or withdraw access to the service, unilaterally and without prior notification, to any User who does not comply with these general conditions of use.
The Grand Est Region implements all reasonable means at its disposal to ensure quality access to the service, but is not bound by any obligation to achieve this.
Furthermore, the Grand Est Region cannot be held liable for any malfunction of the network or servers or any other event beyond reasonable control, which may prevent or degrade access to the service.
The Grand Est Region reserves the right to interrupt, temporarily suspend or modify, without notice, access to all or part of the service, in order to carry out maintenance, or for any other reason, without the interruption giving rise to any obligation or compensation.
Liability
The Fluo Grand Est Service (www.fluo.grandest.fr website and Fluo Grand Est applications) and all the data contained therein are provided for information purposes only and do not incur the liability of the Grand Est Region and the transport authorities involved in the operation and development of the Service.
Information relating to timetables, routes, fares, traffic, etc. has been communicated to the Grand Est Region by the transport operators and/or transport authorities operating within their territorial jurisdiction. Under no circumstances does the Grand Est Region guarantee the accuracy of the information provided.
The Grand Est Region cannot be held responsible for any erroneous information, particularly concerning routes, timetables, stops, fares, etc.
The Grand Est Region reserves the right to make changes and improvements to the Service at any time, which may render it inaccessible. Users must also take into account the various updates during which Grand Est Region communicates any changes to timetables that may occur.
The CO2 emission calculations in the roadmap are calculated on an estimate basis and are made available to the public for information purposes only.
The Grand Est Region cannot be held liable for any damage caused by the use of this information:
- For damage of any kind, direct or indirect, resulting from the use of the Service and, in particular, any operating loss, financial or commercial loss, loss of programmes and/or data, in particular in the information system of the User of the Fluo Grand Est Service;
- For damage of any kind, direct or indirect, resulting from the content and/or use of websites linked to the application or to which Users may have access via the Fluo Grand Est Service and which are not sites or applications of the Grand Est Region;
- In the event of malfunctions attributable to third-party software, whether or not incorporated into the Fluo Grand Est Service or implemented from it;
- In the event of total or partial inability to access the Fluo Grand Est Service and its content;
- In the event of errors and/or omissions in the Fluo Grand Est Service.
When travelling, be careful not to take any unnecessary risks and obey the highway code.
Ownership and reproduction rights
Text/photographs/videos: unless otherwise stated, the text, photos and videos are the property of the Grand Est Region.
The entire site is protected by French and international legislation on intellectual property. All reproduction rights are reserved, including for downloadable documents.All texts, graphics, icons, photographs, maps, logos, videos, sounds, brands and, more generally, all elements making up the site itself may not, in accordance with article L122-4 of the French Intellectual Property Code, be represented or reproduced, in whole or in part, on any medium whatsoever, without the express prior authorisation of the Grand Est Region.
Failure to comply with this prohibition constitutes an act of counterfeiting for which the perpetrator may be held civilly and/or criminally liable. The Grand Est Region reserves the right to take legal action against any person who does not comply with this prohibition.
Similarly, it is strictly forbidden to use or reproduce the name “Fluo Grand Est” and/or its logo, alone or in combination, for any purpose whatsoever and on any medium whatsoever without the prior written consent of the Region.
Personal data
In accordance with articles 26, 27 and 36 of the French Data Protection Act of 6 January 1978, you have the right to object to, access and rectify any personal data held about you.

Hypertext links
The Grand Est Region authorises the creation of a hypertext link to the Fluo Grand Est site for Internet sites such as blogs, information portals and the Internet sites of public or private entities, provided that the said site does not disseminate any illicit content, information of a controversial, pornographic or xenophobic nature or which may, to a greater extent, offend the sensibilities of the general public.
The Grand Est Region reserves the right to request the removal of the link if the site is deemed to be in breach of these rules. It also reserves the right to set up hypertext links directing users to third-party sites. As these sites are not subject to approval by the Region, the latter cannot under any circumstances be held responsible for the content and links contained on the said websites.
Amendments to the T&Cs
The Grand Est Region reserves the right to amend these T&Cs at any time.
Acceptance of the Terms and Conditions
The User accepts these Terms and Conditions.
Any dispute concerning the interpretation or execution of these Terms and Conditions will fall under the exclusive jurisdiction of the French courts, applying French law.
